1. License to Access and Use the Services
KAMHO grants you a limited, non-exclusive,
non-transferable, and revocable license to access and
use the Services solely for the purpose of running
advertising promotion campaigns and revenue optimization
activities for your games or applications, as described
herein. No ownership rights to the Services, proprietary
technology, or underlying algorithms are transferred to
you. All intellectual property rights, including
copyrights, trademarks, and patents, remain the
exclusive property of KAMHO or its licensors.
We reserve the right to modify, suspend, or
discontinue any aspect of the Services at any time, with
or without prior notice. Such modifications may include
updates to enhance ad delivery systems, refine
promotional strategies, or comply with evolving
regulatory requirements. Your continued use of the
Services after such changes constitutes your acceptance
of the updated Terms.
2. Data Privacy and Usage
Your use of the Services is subject to our Privacy
Policy, which explains how we collect, process, and
share data to optimize advertising performance and
promotional outcomes. By using the Services, you consent
to the collection and processing of campaign
data—including user demographics, click-through rates,
conversion metrics, and device identifiers—for the
purpose of refining ad targeting and improving campaign
efficiency.
We use tracking technologies, including cookies,
SDKs, and device fingerprinting, to analyze user
behavior and deliver personalized advertisements. While
you may adjust settings on your browser or device to
limit tracking, please be aware that certain features of
the Services may become less effective or unavailable as
a result.
3. Usage Restrictions
In connection with your use of the Services, you agree
not to:
Violate Applicable Laws: Engage in activities that
breach advertising standards, data privacy regulations
(including but not limited to Hong Kong’s Personal Data
(Privacy) Ordinance), or intellectual property laws.
Disseminate Prohibited Content: Promote content that
is illegal, fraudulent, or infringing in any
jurisdiction, including counterfeit goods, deceptive
marketing, or unauthorized financial schemes.
Tamper with Infrastructure: Attempt to
reverse-engineer, decompile, disable, or otherwise
disrupt the Services’ technical systems, including ad
delivery networks or promotional algorithms.
Misuse Data: Employ unauthorized automated tools to
extract data, manipulate campaign metrics, or collect
personal information without proper consent.
Impersonate or Misrepresent: Falsely claim
association with third parties or with KAMHO in any
manner that could mislead users or harm our reputation.
Resell Unauthorized Services: Monetize, resell, or
distribute ad inventory, data, or user acquisition tools
without prior written authorization from KAMHO.
4. Intellectual Property Rights
All content, materials, trademarks, and proprietary
technology integrated into the Services—including but
not limited to ad delivery algorithms, promotional
frameworks, and campaign analytics tools (collectively,
“Service Content”)—are the exclusive property of
HONGKONG KAMHO INDUSTRIAL CO., LIMITED (“KAMHO”) or its
licensors. You are expressly prohibited from
reproducing, modifying, distributing, or creating
derivative works based on the Service Content without
obtaining prior written authorization from KAMHO.
To report suspected intellectual property
infringement, you must submit a detailed notice
including:
Identification of the Protected Work: A description
of the copyrighted material, trademark, or other
intellectual property allegedly infringed.
Location of the Infringement: Specific references
(e.g., URLs or dashboard locations) where the infringing
material appears within the Services.
Your Contact Information: Your full name, physical
address, email address, and telephone number.
Statement of Good Faith: A declaration that you
believe the disputed use is unauthorized by the rights
holder, its agent, or the law.
Accuracy Declaration: A statement under penalty of
perjury confirming that the information provided is
accurate.
KAMHO reserves the right to remove or disable access
to any content alleged to be infringing pending
investigation.
5. Limitation of Liability
To the fullest extent permitted by Hong Kong law, KAMHO,
its affiliates, directors, employees, and agents shall
not be liable for any direct, indirect, incidental,
special, or consequential damages (including, without
limitation, lost profits, data loss, reputational harm,
or business interruptions) arising out of or in
connection with:
Your access to or use of the Services;
Inaccuracies in campaign performance metrics (e.g.,
user acquisition rates, revenue calculations);
Actions of third parties, including fraudulent ads
or unauthorized data scraping.
The Services are provided on an “as is” and “as
available” basis, without warranties of any kind, either
express or implied. KAMHO disclaims any responsibility
for technical disruptions, data inaccuracies, or
outcomes influenced by factors such as algorithm
updates, market competition, or changing user behaviors.
You acknowledge that advertising promotion and revenue
optimization involve inherent risks and agree to assume
full responsibility for the success of your campaigns.
6. Indemnification
You agree to indemnify, defend, and hold harmless KAMHO
and its representatives from all claims, liabilities,
damages, losses, and expenses (including reasonable
legal fees) arising out of or related to:
Breach of Terms: Any violation of these Terms,
including unauthorized resale or misuse of KAMHO’s
proprietary content or data.
Third-Party Claims: Allegations of intellectual
property infringement, defamation, or privacy violations
related to your campaigns.
Regulatory Actions: Any fines or penalties incurred
due to your failure to comply with applicable laws or
advertising standards.
This indemnification obligation shall survive the
termination of these Terms.
7. Third-Party Links and Services
The Services may integrate with third-party tools, APIs,
or platforms (e.g., ad networks, data analytics
providers, social media channels). KAMHO does not
control or endorse third-party content, and is not
liable for the accuracy, legality, or security practices
of such third-party services. You are responsible for:
Reviewing and complying with third-party terms of
service and privacy policies;
Ensuring that any integrated third-party tools are
used in compliance with applicable laws (including, but
not limited to, GDPR and Hong Kong privacy regulations).
8. Termination and Suspension
KAMHO reserves the right to terminate or suspend your
access to the Services immediately, without prior
notice, if you materially breach these Terms. Material
breaches may include, but are not limited to:
Fraudulent Activities: Engaging in activities such
as click fraud, fake traffic generation, or ad stacking
to manipulate revenue.
Promotion of Illegal or Prohibited Content:
Advertising products or services that are illegal,
unlicensed, or deceptive.
Repeated Non-Compliance: Persistent failure to
adhere to copyright, privacy, or regulatory guidelines.
Upon termination, all licenses granted under these
Terms will immediately cease, and you must promptly:
Cease all use of the Services;
Delete any cached or stored Service Content;
Settle outstanding fees or liabilities.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, excluding its conflict of law principles. Any dispute arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the Hong Kong courts. By using the Services, you consent to the jurisdiction and waive any objections to venue or convenience.
10. Amendments to Terms
KAMHO may update these Terms periodically to reflect changes in our services, business practices, or regulatory requirements. Revised Terms become effective immediately upon publication on our website. Your continued use of the Services after such updates constitutes your acceptance of the amended Terms. We recommend that you review these Terms regularly to stay informed of any changes.
11. Compliance with Hong Kong Laws
As a company registered in Hong Kong, KAMHO adheres to
all applicable local regulations, including but not
limited to:
Personal Data (Privacy) Ordinance (Cap. 486):
Governing the collection, storage, and processing of
personal data.
Trade Descriptions Ordinance (Cap. 362): Prohibiting
false or misleading advertising claims.
Anti-Money Laundering Ordinance (Cap. 615):
Mitigating risks associated with financial fraud.
You agree to comply with all applicable laws and
regulations in your use of the Services. Any violation
may result in immediate termination and reporting to the
appropriate authorities.
12. Prohibited Activities
In addition to the restrictions set forth in Section 3,
you are expressly prohibited from using the Services to:
Promote Unlicensed Financial Products: Including
cryptocurrency schemes without appropriate regulatory
approvals or high-risk investments.
Target Vulnerable Populations: Engage in deceptive
advertising or predatory practices targeting minors, the
elderly, or disadvantaged individuals.
Distribute Malicious Software: Embed harmful code,
spyware, or phishing content within your ad campaigns or
associated landing pages.
Circumvent Platform Policies: Employ cloaking
techniques, disguised redirects, or other methods
designed to evade ad review processes.
13. User-Generated Content
When you submit advertising creatives, targeting
specifications, or campaign parameters (“User
Materials”) via the Services, you retain ownership of
such materials. However, by submitting User Materials,
you grant KAMHO a non-exclusive, royalty-free, worldwide
license to:
Store, reproduce, and modify User Materials to
ensure technical compatibility;
Display and distribute User Materials across our
partnered platforms and ad inventories;
Analyze and aggregate campaign performance data to
enhance future services.
You represent and warrant that User Materials do not
infringe on third-party rights, adhere to applicable
laws, and contain no harmful code or deceptive elements.
KAMHO reserves the right to remove or alter User
Materials that violate these Terms.
14. Advertising Transparency
The Services may display third-party advertisements,
sponsored content, or promotional offers. For example:
In-App Ad Placements: Your game may display
dynamically served ads based on user behavior and
geographic location.
Analytics Dashboards: Our tools may recommend
complementary services (e.g., A/B testing solutions).
KAMHO does not guarantee the accuracy, legality, or
quality of third-party advertisements. Interactions with
third-party advertisers, including transactions and data
sharing, are solely your responsibility. Participation
in promotions through the Services requires adherence to
the specific rules provided at the time of enrollment.

using the Services immediately.
